The Bode City Council met in Regular session Monday July 12th at 5:30PM in the council chambers, the date had been changed due to the 4th of July Holiday the prior week. All members were present, Council Fulwider arrived at 6PM. Mayor Miller called the meeting to order, with a motion by Douglas, second by Peterson to approve the agenda as posted. A motion was made by Peterson, second by Douglas to approve the minutes of the June 7th council meeting as published. All ayes, motion carried.

Todd McMahon, city maintenance reported he had moved a valve on the tag axle of the garbage truck, and was hoping this would correct the problems when entering the landfill. He also stated that he would install an outside spicket at the Community Center to allow adequate watering to the area that will be landscaped through the funding of the “America Grows Farmers” Bayer funding.

Ashley Hendricks and Rhonda Small were present to discuss burning of items that have taken place by the Bode Apartments. They showed several pictures and Videos of Open burning; this outline is defined in the Iowa Administrative Code Sections 567—23.2(455B) Open burning. Council member Douglas complied a list of “Recreational Burning Regulations”. Following discussion council member Peterson tabled “Recreational Burning Regulations” until the August Council Meeting. The managers of the apartments were notified during the council meeting, that all “Open Burning” should seize immediately.

A motion was made by Peterson, second by Tepner to approve the building permit located at 403 7th street for an addition of a bedroom/bathroom and also an addition to increase the garage size. All ayes, motion carried.

A motion was made by Tepner, second by Douglas to approve a L shaped decorative fence at 300 College Ave. All ayes, motion carried.

Several Certified Letters had been sent out to properties that were not in compliance with the City Code of Ordinances, the council reviewed each letter. Following review, it was determined to remove a vehicle at 400 Christiana Ave and start the process of cleaning up the property at 301 Rossing Ave. A motion was made by Douglas, second by Peterson to also start the process of a judgement on the property located at 501 7th street. All ayes, motion carried.

A motion was made by Fulwider, second by Douglas to contact our attorney on the lawful process of completing the “Clean Up” of these properties. All Ayes, motion carried. Council member Douglas will contact our attorney and also contact another law firm should a conflict of interest take place; to start this process as soon as possible.

City Clerk informed council of the “American Rescue Plan” and will start the process of possibly receiving funds from the federal government to be used for water/sewer infrastructure.

A motion was made by Tepner, second by Douglas to set the next meeting as August 2nd. All ayes, motion carried.
